Why so many old games are hard to play legally

A preservation study exposes a gap between the games that shaped the medium and the games people can still buy today.

Something can be culturally important and commercially unavailable at the same time. The Video Game History Foundation's 2023 study estimated that only about 13% of classic US games in its examined period were still commercially available. That was a study of a defined sample and methodology, not a live 2026 census of every game on Earth.

Why availability disappears

Rights can involve publishers, music, licensed characters, engines and online infrastructure. Old hardware and storage media fail. A removed digital listing may also be different from an already purchased game remaining downloadable; the terms vary by storefront and title.

What a remake can and cannot preserve

A remake can make an old story accessible to new players, but it is a new interpretation. Changes to movement, visual composition, dialogue and music can alter the original work. A remaster or emulated release may preserve more of the old design, although neither label guarantees perfect historical accuracy.

The role of archives

Libraries and preservation organisations catalogue physical copies, technical information, publications and recordings even when copyright limits how playable software can be shared. Their work gives later researchers something beyond modern marketing and nostalgic memory.

How readers can help

Keep legally owned manuals, game cases and release information organised; document regional differences and credit the people who made the work. For any game you want to play now, check official current availability, storefront terms and the specific edition. Do not read a historical availability percentage as permission to infringe rights.
